01

Copyright policy

MVA Crash Collect respects intellectual property rights and expects users and service providers to do the same. This notice describes the process for reporting material on mvacrashcollect.com that you believe infringes a United States copyright.

This procedure is intended to comply with the Digital Millennium Copyright Act, 17 U.S.C. § 512. It is not legal advice.

02

Notice of claimed infringement

To submit a copyright infringement notice, send a written communication to our designated copyright agent containing substantially all of the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed or, for multiple works at one site, a representative list of those works.
  3. Identification of the material claimed to be infringing or the subject of infringing activity, plus information reasonably sufficient for us to locate it, such as the exact URL.
  4. Your name and information reasonably sufficient for us to contact you, such as a mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the complained-of manner is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right allegedly infringed.

Notices that omit required information may not be effective and may delay our response.

04

Counter-notification

If content you provided was removed or disabled because of a copyright notice and you believe the removal resulted from mistake or misidentification, you may send a written counter-notification to the designated agent that includes substantially the following:

  1. Your physical or electronic signature.
  2. Identification of the material removed or disabled and the location where it appeared before removal or disabling.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, plus a statement that you consent to the jurisdiction of the appropriate United States federal district court and will accept service of process from the person who submitted the original notice or that person’s agent.

After receiving a valid counter-notification, we may provide it to the original complaining party and may restore the material in accordance with applicable law unless the complaining party informs us that it has filed an action seeking a court order.

05

Repeat infringers

Where appropriate and in our discretion, we may terminate or restrict access by users or account holders who are repeat infringers or who repeatedly submit infringing material.

06

Misrepresentations

Knowingly and materially misrepresenting that material is infringing or that material was removed by mistake may result in liability under 17 U.S.C. § 512(f). Consider consulting an attorney before submitting a notice or counter-notification.

07

Other intellectual property concerns

For trademark, publicity, privacy, or other non-copyright concerns, email info@mvacrashcollect.com with sufficient detail for us to review the issue. The DMCA process is specifically for copyright claims.
